The Scottish Ministers, in exercise of the powers conferred by articles 17(1) and 30(1) of the Foot-and-Mouth Disease Order 1983[1] and of all other powers enabling them in that behalf, hereby make the following Order: Citation and commencement 1. This Order may be cited as the Foot-and-Mouth Disease (Scotland) (Declaratory and Controlled Area) Amendment (No. 5) Order 2001 and shall come into force on 19th May 2001. Amendment of the Foot-and-Mouth Disease Declaratory (Controlled Area) (Scotland) (No. 3) Order 2001 2. - (1) The Foot-and-Mouth Disease Declaratory (Controlled Area) (Scotland) (No. 3) Order 2001[2] is amended in accordance with this article. (2) In article 4(4)[3], for "in the form set out in Schedule 1 to this Order and subject to the conditions set out in that Schedule" there is substituted "in a form to be prescribed by the Scottish Ministers in accordance with the advice of the Chief Veterinary Officer". (3) For article 4(9B)[4], there is substituted-
(4) Schedule 1 is omitted.
(b) the Foot-and-Mouth Disease (Scotland) Declaratory (No. 6) Order 2001[6].
(3) In paragraph 2(c) of Schedule 2, for "in the form set out in Schedule 3 to this Order", there is substituted "in a form to be prescribed by the Scottish Ministers in accordance with the advice of the Chief Veterinary Officer".
