The Scottish Ministers, in exercise of the powers conferred on them by section 2(2) of the European Communities Act 1972[1] and of all other powers enabling them in that behalf, hereby make the following Regulations: Citation, commencement and extent 1. - (1) These Regulations may be cited as the Bovines and Bovine Products (Trade) Amendment (Scotland) Regulations 2000 and shall come into force on 17th July 2000. (2) These Regulations extend to Scotland only. Amendments to the Bovines and Bovine Products (Trade) Regulations 1999 2. - (1) The Bovines and Bovine Products (Trade) Regulations 1999[2] are amended in accordance with the following paragraphs of this regulation. (2) In the definition of "export dedicated establishment" in paragraph (1) of regulation 2 (interpretation) the phrase "and may include such establishments which prepare DBES goods destined for placing on the market in the United Kingdom" is inserted after the word "below". (3) In paragraph (a) of the definition of "export eligible goods" in paragraph (1) of regulation 2 (interpretation) the phrase "(other than any such goods destined for placing on the market in the United Kingdom)" is inserted after the word "goods" where it appears first. (4) In paragraph (1)(b) of regulation 12 (approval of establishments for the preparation or despatch of foreign origin export eligible goods, DBES and ECHS goods and foreign origin bovine by-products) the word "origin" is substituted for the word "original". (5) In paragraph (3)(a) of regulation 12 the phrase "or DBES goods destined for placing on the market in the United Kingdom" is inserted after the word "goods" where it appears last. (6) In paragraph (3)(c)(i) of regulation 12 the phrase "other than DBES goods destined for placing on the market in the United Kingdom" is inserted after the word "abroad". (7) In paragraph (3)(c)(ii) of regulation 12 the phrase "other than DBES goods destined for placing on the market in the United Kingdom" is inserted at the end. (8) In sub-paragraph (a) of paragraph (3) of regulation 13 (requirements imposed on the operator of an establishment approved under regulation 12) the phrase ", DBES goods" is omitted. (9) In paragraph (6) of regulation 13 the phrase "or DBES goods destined for placing on the market in the United Kingdom" is inserted after the word "goods". (10) In paragraph (13) of regulation 13 the word "become" is substituted for the word "are". (11) In requirement 5 in the first column of Schedule 2 (required methods of operation for the preparation of export eligible goods in export dedicated establishments) the phrase "or DBES goods destined for placing on the market in the United Kingdom" is inserted at the end. ROSS FINNIE A member of the Scottish Executive St Andrew's House, Edinburgh 13th June 2000 EXPLANATORY NOTE (This note is not part of the Regulations) These Regulations amend the Bovines and Bovine Products (Trade) Regulations 1999 (S.I. 1999/1103, as amended) insofar as they extend to Scotland. Those Regulations extend to the whole of Great Britain. The effect of the amendments is to permit the despatch of bone-in beef from premises approved under the Date Based Export Scheme to the domestic market. A Regulatory Impact Assessment, which includes a compliance cost assessment of the effect which these Regulations will have on business costs, has been prepared and placed in the Scottish Parliament Information Centre and copies can be obtained from the Scottish Executive Rural Affairs Department (Livestock, Animal Health and Welfare Division), Pentland House, 47 Robbs Loan, Edinburgh EH14 1TW.
