Subject_Bill of Exchange,—Indefinite Payment.—
Special case, in which the charger, holding two acceptances by the same party, had used arrestments on both acceptances, in the hands of one debtor; and the suspender, who, as drawer, was connected with only one of the bills, attempted to establish that what was recovered (or should have been recovered) from the arrestee, was imputable exclusively to that bill on which he was drawer. The Court held, that, in the circumstances, the charger was entitled to impute the amount in question exclusively to the other bill, and adhered to the interlocutor of the Lord Ordinary, refusing the bill of suspension with expenses.
