Subject_Cessio.—
Auld, pursuer of a process of cessio bonorum, had been adjutant in a regiment of local militia, and subsequently was engaged in trade. His half-pay amounted to £73. He was sixty-four years of age, had a wife who carried on business as a milliner, and seven children, of whom four had barely the means of supporting themselves, two were in trade, but bankrupt, and one was an infant.
The creditors having demanded a surrender of part of his half-pay, the Court ordained £10 to be assigned, and found him entitled to the benefit of cessio.
