The Department of Agriculture, Environment and Rural Affairs makes these regulations in exercise of the powers conferred by section 50 of, and paragraphs 1(1) and 2(2) of Schedule 4 to, the Environment Act 2021 (“ the Act”)( 1) and now vested in it( 2).
The Department of Agriculture, Environment and Rural Affairs makes these Regulations after consultation in accordance with paragraph 8 of Schedule 4 to the Act and is satisfied as to the matters specified in paragraph 9(1) of that Schedule.
1. These Regulations may be cited as the Producer Responsibility Obligations (Packaging Waste) (Amendment) Regulations (Northern Ireland) 2023 and come into operation on 1st January 2024.
2.—(1) The Producer Responsibility Obligations (Packaging Waste) Regulations (Northern Ireland) 2007( 3) are amended as follows.
(2) In Schedule 2 (recycling obligations)—
(a) for paragraph 5 substitute—
“5. The percentage which is prescribed as the recycling target “X” for the year 2024 is 80%. ”;
(b) in paragraph 6, for Table 2 substitute—

These Regulations amend the Producer Responsibility Obligations (Packaging Waste) Regulations (Northern Ireland) 2007 ( S.I. 2007 No. 198) (the “ 2007 Regulations”). The 2007 Regulations impose on producers the obligation to recycle packaging waste in order to attain the recycling targets set out in Article 6(1) of European Parliament and Council Directive 94/62/ECon packaging and packaging waste (OJ No L 365, 31.12.94, p10), as last amended by Directive (EU 2018/852).
These Regulations set an overall recycling target as well as material-specific recycling targets for 2024 on obligated producers in Northern Ireland in relation to glass, plastic, aluminium, steel, paper/board, and wood.
The Department of the Environment was dissolved by section 1(9) of the Departments Act (Northern Ireland) 2016 and, by virtue of Article 8(1)(c) of the Departments (Transfer of Functions) Order (Northern Ireland) 2016, its functions for the purposes of these Regulations were transferred to the Department of Agriculture, Environment and Rural Affairs
