The First Minister and deputy First Minister, acting jointly, made on 18th January 2022 a determination under section 1(1) of the Financial Assistance Act (Northern Ireland) 2009( 1); and, acting jointly, they have designated the Department for Communities( 2) as the relevant department under section 1(3)(a) of that Act.
Accordingly, the Department for Communities, makes the following Regulations in exercise of the powers conferred by sections 1(2) and 3(1)(e), (h) and (i) of that Act.
In accordance with section 1(4) of that Act, the Executive Office( 3) approves the making of these Regulations.
1. These Regulations may be cited as the Energy Payment Support Scheme (Amendment) Regulations (Northern Ireland) 2022 and shall come into operation on 10th March 2022.
2.—(1) The Energy Payment Support Scheme Regulations (Northern Ireland) 2022( 4) are amended in accordance with paragraph (2).
(2) After paragraph 5 of the Schedule (appeals) insert—
5A. No account shall be taken of eligibility for an Energy Payment in considering a person’s entitlement to a payment under any of the following social security benefits:
(a) income support;
(b) jobseekers allowance;
(c) employment and support allowance;
(d) universal credit; or
(e) state pension credit. ”.

These Regulations provide for payments (“Energy Payments”) to be disregarded for social security benefit purposes.
Regulation 2 inserts a disregard provision into the Energy Payment Support Scheme (Northern Ireland) 2022 ( S.R. 2022 No. 28).
This Scheme will apply to Northern Ireland only.
A regulatory impact assessment has not been produced for the Regulations as they have no impact on the costs of business.
