The Department of Education (a), in exercise of the powers conferred by section 18(2) of the Special Educational Needs and Disability Act (Northern Ireland) 2016( 1), makes the following Order.
1. This Order may be cited as the Special Educational Needs and Disability (2016 Act) (Commencement No. 2) Order (Northern Ireland) 2020.
2. The day appointed for coming into operation of section 1 of the Special Educational Needs and Disability Act (Northern Ireland) 2016 is 18th December 2020.

This Order brings into operation section 1 of the Special Educational Needs and Disability Act (Northern Ireland) 2016.
Section 1 inserts a new Article 5A into the Education (Northern Ireland) Order 1996 ( S.1. 1996/274 (N.I. 1)). Article 5A requires the Education Authority, so far as reasonably practical, to seek and have regard to the views of the child. It further requires the Education Authority to have regard to the importance of that child participating in decisions and being provided with the information and support necessary to enable participation in those decisions.
