The Department of Agriculture and Rural Development is a department designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Union and in relation to matters relating to the promotion of rural development.
The Department of Agriculture and Rural Development makes the following Regulations in exercise of the powers conferred by section 2(2) of that Act.
1. These Regulations may be cited as The Less Favoured Area Compensatory Allowances (Amendment) Regulations (Northern Ireland) 2015 and shall come into operation on 4th June 2015.
2. For Regulation 11 (3) of the Less Favoured Area Compensatory Allowances Regulations (Northern Ireland) 2015(3) substitute
"(3) For the purposes of this regulation, interest shall be charged from the payment deadline as recorded in the recovery notice issued by the Department.
(3A) For the purposes of paragraph (3) the payment deadline shall be set at 60 days from the date of the recovery notice issued by the Department."

These Regulations amend regulation 11 (3) of The Less Favoured Area Compensatory Allowances Regulations (Northern Ireland) 2015 in relation to the interest on undue payments of less favoured area compensatory allowances recovered from a beneficiary by the Department of Agriculture and Rural Development. This interest is to be applied between the deadline for payment set in the recovery notice and the date of the recovery of the payments in question. The payment deadline must be 60 days after the date of the recovery notice.
S.I. 2000/2812 and S.I. 2000/3238 to which there are amendments not relevant to the subject matter of these Regulations
