The Department of Agriculture and Rural Development is designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2), in relation to the common agricultural policy of the European Community and in relation to matters relating to the promotion of rural development.
The Department of Agriculture and Rural Development makes the following Regulations in exercise of the powers conferred by that section.
1.–(1) These Regulations may be cited as The Organic Farming (Amendment) Regulations (Northern Ireland) 2008 and shall come into operation on 1st January 2009.
(2) The Interpretation Act (Northern Ireland) 1954(3) shall apply to these Regulations as it applies to an Act of the Assembly.
2.–(1) The Organic Farming Regulations (Northern Ireland) 2008(4) shall be amended as follows.
(2) In paragraph 2 of regulation 2 (Interpretation), for the definition of "the Council Regulation", substitute - "means Council Regulation (EEC) No 834/2007(5) of 28 June 2007 on organic production and labelling of organic products and repealing Regulation (EEC) No 2092/91"".

These Regulations amend the Organic Farming Regulations (Northern Ireland) 2008 by amending the interpretation of "the Council Regulation" to take account of the introduction of Council Regulation (EEC) No 834/2007 of 28 June 2007, which repeals and replaces Council Regulation (EEC) No 2092/91 from 1 January 2009.
