Coming into operation in accordance with regulation 1
1.–(1) These Regulations may be cited as the Social Fund (Cold Weather Payments) (General) (Amendment) Regulations (Northern Ireland) 2008.
(2) This regulation and regulation 2 shall come into operation on 27th October 2008 immediately after the Employment and Support Allowance (Consequential Provisions) Regulations (Northern Ireland) 2008(3) come into operation.
(3) Regulation 3 shall come into operation on 1st November 2008.
(4) In these Regulations "the principal Regulations" means the Social Fund (Cold Weather Payments) (General) Regulations (Northern Ireland) 1988(4).
(5) The Interpretation Act (Northern Ireland) 1954(5) shall apply to these Regulations as it applies to an Act of the Assembly.
2. In regulation 1A(2)(6) of the principal Regulations (prescribed description of persons) for "and (ab)" substitute ", (ab), (ad) and (ae)".
3. For the purpose of making a payment in respect of a period of cold weather which begins at any time after 31st October 2008 but before 1st April 2009, regulation 3(7) (prescribed amount) of the principal Regulations is applied as if the reference to £8.50 were to £25.00.

These regulations amend the Social Fund (Cold Weather Payments) (General) Regulations (Northern Ireland) 1988 ("the principal Regulations").
Regulation 2 amends regulation 1A(2) of the principal Regulations to correct an omission of a cross reference to paragraphs (1)(ad) and (ae) as inserted by the Employment and Support Allowance (Consequential Provisions) Regulations (Northern Ireland) 2008. These paragraphs are inserted, as recipients of Employment and Support Allowance who are resident in care homes, independent hospitals and other similar establishments are not eligible for cold weather payments.
Regulation 3 provides that for winter 2008/09 a cold weather payment will be £25 instead of £8.50.
These Regulations make in relation to Northern Ireland only provision corresponding to provision in Regulations made by the Secretary of State for Work and Pensions in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act 1992, are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.
