The Department of Enterprise, Trade and Investment[
1] makes the following Order in exercise of the powers conferred on it by Article 9(1)and (3)[
2] of the Electricity (Northern Ireland) Order 1992[
3] and of every other power enabling it in that behalf, after consultation with the Northern Ireland Authority for Utility Regulation.
Citation and Commencement
1.
This Order may be cited as the Electricity (Class Exemptions from the Requirement for a Licence) (Amendment) Order (Northern Ireland) 2007, and shall come into operation on 1 November 2007.
Amendment of the Electricity (Class Exemptions from the Requirement for a Licence) Order (Northern Ireland) 1999
2.
Class D (Relevant exempt self suppliers) of Schedule 2 to the Electricity (Class Exemptions from the Requirement for a Licence) Order (Northern Ireland) 1999[
4] is hereby revoked.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order revokes the Class D Exemption (Relevant exempt self suppliers) contained in Schedule 2 to the Electricity (Class Exemptions from the Requirement for a Licence) Order (Northern Ireland) 1999.
The Class D exemption enables a consumer, whose electricity demand exceeds one megawatt and who meets other prescribed criteria, to enter into an agreement whereby he can take direct provision of an electricity supply to premises he occupies, without having to hold a licence under Article 10(1)(c) or (2) of the Electricity (Northern Ireland) Order 1992.
