Environmentally Sensitive Areas Designation (Amendment) Order (Northern Ireland) 2006

Whereas, in accordance with Article 3(1) of the Agriculture (Environmental Areas) (Northern Ireland) Order 1987[
1] ("the 1987 Order"), it appears to the Department of Agriculture and Rural Development ("the Department") that it is particularly desirable—
(a) to conserve and enhance the natural beauty of the areas referred to in Article 3 and Schedule 1 of the Environmentally Sensitive Areas Designation Order (Northern Ireland) 2005[2];
(b) to conserve the flora and fauna and geological and physiographical features of those areas; and
(c) to protect buildings and other objects of archaeological, architectural or historic interest in those areas;
And whereas, in accordance with the said Article 3(1) of the 1987 Order, it appears to the Department that the maintenance and adoption of the agricultural methods specified in Schedules 2, 4 and 5 of the Environmentally Sensitive Areas Designation Order (Northern Ireland) 2005 are likely to facilitate the aforementioned conservation, enhancement and protection;
Now, therefore, the Department, in exercise of the powers conferred on it by Article 3(1) and (3) of the 1987 Order and of every other power enabling it in that behalf, and with the consent of the Department of Finance and Personnel, hereby makes the following Order:
Citation, commencement and interpretation

—(1) This Order may be cited as the Environmentally Sensitive Areas Designation (Amendment) Order (Northern Ireland) 2006 and shall come into operation on 3rd July 2006.
(2) In this Order—
"the principal Order" means the Environmentally Sensitive Areas Designation Order (Northern Ireland) 2005.
Amendment of Article 2 of the principal Order
3.
In Article 2 (Interpretation)—
(1) in paragraph 2, after the definition of "heritage feature", there is inserted—
"indigenous rare breeds" means domestic livestock breeds indigenous to Northern Ireland;“
Amendment of Schedule 4 to the principal Order
4.
In Schedule 4 to the principal Order (Additional Matters in respect of which the Department may make payments), after paragraph 17—
(1) in column 1 there is inserted—
"

In relation to indigenous rare breeds—breeding of Irish Moiled Cattle"
(2) in column 2 there is inserted—
"
£125 per female animal or bull kept for a full 12 months."
Transitional provision
5.
Articles 2 and 3 shall not apply in a case where payment has been approved by the Department for the purposes of a grant under Article 4 of the principal Order before the coming into operation of this Order.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order amends the Environmentally Sensitive Areas Designation Order (Northern Ireland) 2005 ("the principal Order") by providing for payment of a grant in respect of breeding indigenous rare breeds, specifically the breeding of Irish Moiled Cattle (Articles 2 and 3).
A transitional provision has been included for applications approved by the Department of Agriculture and Rural Development before the coming into operation of this Order (Article 4).
