EXPLANATORY NOTE
(This note is not part of the Order)
This Order brings the Disability Discrimination Code of Practice for Schools into effect on 30th January 2006. The Code of Practice was issued by the Equality Commission for Northern Ireland under section 54A of the Disability Discrimination Act 1995.
The Code provides practical guidance for Schools on how to avoid committing acts which are unlawful under, and other matters relating to, the operation of the Special Educational Needs and Disability (Northern Ireland) Order 2005 which came into effect from 1
st September 2005.
Failure to observe any provision of this Code does not in itself make a person liable to any proceedings but, the Special Educational Needs and Disability Tribunal (the Tribunal) may take the Code into account when determining any questions arising out of proceedings under Part 111 Chapter 1 of the Special Educational Needs and Disability (Northern Ireland) Order 2005.
