The Department of Health, Social Services and Public Safety[
1], in exercise of the powers conferred on it by section 2(3) of the Health and Personal Social Services Act (Northern Ireland) 2001[
2] and of all other powers enabling it in that behalf hereby makes the following Regulations:
Citation and interpretation
1.
- (1) These Regulations may be cited as the Northern Ireland Social Care Council (Description of persons to be treated as social care workers) Regulations (Northern Ireland) 2004 and shall come into operation on 1st April 2004.
(2) In these Regulations "the Act" means the Health and Personal Social Services Act (Northern Ireland) 2001.
Description of persons to be treated as social care workers
2.
For the purposes of section 2(3) of the Act ("Social care worker", etc.), a person participating in a course approved by the Council under section 10 of the Act for persons wishing to become social workers, shall be treated as a social care worker.

EXPLANATORY NOTE
(This note is not part of the Order.)
These Regulations are made under section 2(3) of the Health and Personal Social Services Act (Northern Ireland) 2001 ("the Act") and provide that persons who are undertaking a course which has been approved by the Northern Ireland Social Care Council under section 10 of the Act are to be treated as social care workers for the purposes of section 2 of the Act.
