Powers as to disallowance and surcharge. 82.(1) Any person who is aggrieved by a decision of a local government auditor on any matter with respect to which he made an objection at the audit, and any person aggrieved by a disallowance or surcharge made by a local government auditor, may appeal either to the High Court or, in the prescribed manner and within the prescribed period, to the Ministry. (2) Where an appeal is made to the Ministry under this section (a)section 22 of the Interpretation Act (Northern Ireland) 1954 (powers of appellate courts) shall apply as if any reference in it to the appellate court were a reference to the Ministry; (b)the Ministry may at any stage of the proceedings, and shall if so directed by the Court of Appeal, state in the form of a special case for the opinion of the Court of Appeal any question of law arising in the course of the appeal; (c)subject to paragraph (b), the Ministry's decision shall be final.
