Power of entry. 25.(1) Subject to subsection (2), any person guilty of an offence of cruelty within the meaning of this Part shall be liable on summary conviction (a)in the case of a first offence, to a term of imprisonment not exceeding three months, or to a fine not exceeding #100 or to both; (b)in the case of a second or subsequent offence, to such imprisonment or to a fine not exceeding #200 or to both. (2) Where the owner of an animal is convicted of permitting cruelty within the meaning of this Part by reason only of his having failed to exercise reasonable care and supervision, he shall not be liable to imprisonment without the option of a fine.
