Penalties and legal proceedings. 3.(1) A person guilty of an offence under this Act shall be liable on summary conviction to imprisonment for a term not exceeding three months or to a fine not exceeding one hundred pounds, or to both. (2) Proceedings for an offence under this Act shall not be instituted except by the Ministry or by or with the consent of the Attorney General. (3) Notwithstanding section 34 of the Magistrates' Courts Act (Northern Ireland) 1964, proceedings for an offence under this Act may be commenced at any time within twelve months after the date on which the offence was committed or within three months after the date on which evidence sufficient to justify the proceedings comes to the Ministry's knowledge, whichever period last expires. (4) For the purposes of subsection (3) a certificate of the Ministry as to the date on which such evidence as aforesaid came to the Ministry's knowledge shall be prima facie evidence.
