Order may be postponed until the rights are declared in a suit. 53. Upon any petition under this Act being presented to the [High Court] ... it shall be lawful for the [High Court] ... to postpone making any order upon such petition until the right of the petitioner or petitioners shall have been declared in a suit duly instituted for that purpose.
