Provisions as to altering level of streets when tramways are made through towns. 39. Where any tramway shall be made through any city or town, it shall not be lawful to alter the level of any street therein without the consent of two-thirds of the owners of the houses adjoining the same, or in such a manner as to prevent convenient access to all the houses adjoining such street; and in no case shall the level be altered more than four feet; and when any street shall be so raised or sunk, the whole of the surface of the roadway of such street shall be brought by the promoters to the same level, unless it shall appear to the Board of Works that such alteration is objectionable.
