Special provisions as to evidence. 38.(1) If a person employed in or about the business of a shop is found in a shop at any time at which work is going on in the shop or when the shop is open for the serving of customers, except during the intervals for meals or rest, he shall until the contrary is proved be deemed for the purposes of this Act to have been then employed in the shop: Provided that this sub-section shall not apply to a shop in which the only persons employed are members of the same family dwelling there. (2)Where in any proceedings under this Act with respect to a young person it appears to the court that that young person is apparently of or below the age alleged by the informant, it shall lie on the defendant to prove that the young person is not of or below that age. Subs.(3) rep. by 1955 c.29 (NI) s.5 sch.3 (4) Any order made by a [district council] under this Act may be proved by the production of a copy thereof certified to be a true copy by the person purporting to be the clerk of the [district council] by whom the order was made.
