17.(1) Any person who suffers loss by reason of the breach of any duty imposed under the Registration of Deeds Acts upon an officer or servant of the Ministry may, by action (a)where the amount claimed does not exceed [#2,000], in the county court; or (b)where the amount claimed exceeds [#2,000], in the High Court; (2) Damages recovered from the Ministry under subsection (1) shall be defrayed out of moneys provided by Parliament.
