Escapes, etc. 26. Every person who (a)having been convicted of an offence, escapes from any lawful custody, whether in prison or not, in which he may be under such conviction; or (b)whether convicted or not, escapes from any prison or lock-up in which he is lawfully confined; or (c)being in any lawful custody otherwise than as aforesaid escapes from such custody; or (d)being on bail, whether prior to or during his trial or while an appeal against his conviction is pending, does not, without lawful excuse, the proof whereof shall lie on him, present himself at the proper time and place to stand his trial or for the hearing of the appeal or to receive sentence, as the case may be, Attempts to break prison.
