47.(1) Where an accident in any premises to which this Act applies or in any common part (within the meaning of section 42) of a building of which such premises form part (a)causes loss of life to a person employed to work in the premises; or (b)disables any such person for more than three days from doing his usual work; (2) Where an accident causing disablement is notified under this section, and after notification thereof results in the death of the person disabled, notice of the death shall, as soon as it comes to the knowledge of the occupier of the premises in which the accident occurred, be sent by him to the appropriate authority. (3) Where an accident to which this section applies occurs to a person employed to work in any premises to which this Act applies and the occupier of the premises is not the actual employer of the person killed or disabled, the actual employer shall, if he fails to report the accident to the occupier immediately, be guilty of an offence and liable [on summary conviction] to a fine not exceeding ten pounds. Subs.(4) rep. by SR 1979/284 (5) In this section "appropriate authority", in relation to any premises, means the authority having, ..., the power to enforce sections 4 to 27 with respect to the premises.
