NURSES AND MIDWIVES ACT (NORTHERN IRELAND) 1970 - SECT 41



41.(1) Where a [Health and Social Services Board] suspends a midwife from
practice in order to prevent the spread of infection, she shall be entitled to
recover from the [Health and Social Services Board], if she is not herself in
default, such amount by way of compensation for loss of practice as is
reasonable in the circumstances of the case.

(2) Where, under rules made in that behalf, the Council or a [Health and
Social Services Board] suspends a midwife from practice pending the decision
of her case by the Disciplinary Committee or by the High Court on an appeal
from the Disciplinary Committee, and the case is decided in her favour,
the Council, if she was suspended by the Council, or, in any other case, the
[Health and Social Services Board] shall pay her such reasonable compensation
for loss of practice as appears to them to be just.
