38. Every [Health and Social Services Board] (a)shall exercise general supervision, in accordance with rules made under this Act, over all midwives practising within their area; (b)shall investigate charges of malpractice, negligence or misconduct on the part of any midwife practising within their area, and, if a prima facie case is established, report it to the Council; (c)shall suspend any midwife from practice, in accordance with rules made under this Part, if such suspension appears to them to be necessary in order to prevent the spread of infection; (d)shall report forthwith to the Council the name of any midwife practising within their area who is convicted of any offence under this Act; (e)shall report forthwith to the Council the death of any midwife practising within their area or any change in the name or address of any such midwife; and (f)shall supply to the Council, in the month of February in each year, the names and addresses of all midwives who during the period of twelve months immediately preceding 31st January in that year have notified the [Health and Social Services Board] of their intention to practise within the [Board's] area.
