1.(1) Where, on a sale of land, an auctioneer, estate agent or other person acting as agent for the vendor in the sale is entitled to be paid a commission, any stipulation made on the sale to the effect that the purchaser shall pay the whole or any part of the commission is void. (2) This section applies to a commission on a fine, or payment in the nature of a fine, on the granting of a lease or sub-lease in like manner as to the commission on a sale of land. (3) In this section "commission" includes fees, charges, disbursements, expenses and remuneration and "enactment" includes any statutory provision within the meaning of section 1(f) of the Interpretation Act (Northern Ireland) 1954. (4) This section applies only to contracts for sale made after the commencement of this Act but does not apply to the acquisition of land by agreement by a person or body authorised or capable of being authorised under an enactment in force at the date of the agreement to acquire that land compulsorily.
