MENTAL HEALTH ACT (NORTHERN IRELAND) 1961 - SECT 43



43.(1) It shall be the duty of [a social worker] to make an application for
admission or a guardianship application in respect of a patient within the
area of the [Health and Social Services Board] by whom that officer is
appointed in any case where

(a)he is satisfied that such an application ought to be made; and

(b)he is of opinion, having regard to any wishes expressed by relatives of
the patient or any other relevant circumstances, that it is necessary or
proper for the application to be made by him.

(2) Nothing in this section shall be construed as authorising or requiring an
application to be made by [a social worker] in contravention of sub-section
(2) of section thirteen, or of that sub-section as applied by section
twenty-one, or as restricting the power of [a social worker] to make any
application under this Act.
