32.(1) Save as is otherwise provided by or under this Act or by any other statutory provision, the registered owner of any land shall alone be entitled to deal with that land by registered disposition. (2) Except as provided by this subsection, nothing in this Act shall prevent a person from creating any estate in any registered land as if that land had been unregistered land; but (a)all estates in registered land shall be subject to the provisions of this Act; and (b)without prejudice to paragraph 1 of Part I of Schedule 7, a mortgage or other deed of charge, in whatever form expressed, shall, in so far as it relates to registered land, operate only to create a charge and not to vest any freehold or leasehold estate (whether or not subject to defeasance) in the land in the person in whose favour the mortgage or other deed of charge is created.
