Certain charges not incumbrances. 36. The following charges and interests shall not be deemed incumbrances within the meaning of this part of this Act; that is to say, (1)Quitrents and rentcharges in lieu of tithes: (2)Rights of common, rights of way, watercourses, and rights of water and other easements: (3)Heriots, manorial rights of all descriptions, and franchises: (4)Charges for drainage, or other charges created under Act of Parliament, and to be specified in the conveyance. As to the distribution of purchase money.
