Setting aside proceedings against official assignee. 66. If [the] official assignee is made a defendant in any action in respect of such money or negotiable instruments, [the court] in which the action is brought may, upon an affidavit of facts, stay or set aside the proceedings in such action so far as the official assignee is concerned, and make such order as to costs as to [the court] shall seem meet.
