Court may expunge proof of any debts not due. 263. Whenever it shall appear that any debt proved or admitted is not justly due, either in whole or in part, the assignees or any creditor may make representation thereof to the Court; and it shall be lawful for the Court to summon and examine upon oath any person whose evidence may appear to the Court to be material, either in support of or in opposition to any such debt; and if the Court shall be of opinion that such debt is not due, either wholly or in part, the Court shall be at liberty to expunge the same, either wholly or in part, from the proceedings, and make such order therein as to costs as to the Court shall seem fit.] S.264 rep. by 1872 c.58 s.5 sch.(A) Appointment of creditors assignees.
