Recovery of part of certain commuted sums. 48.(1) Where (a)in accordance with a housing subsidy order made under section one of the Housing (No. 2) Act (Northern Ireland), 1946, an annual sum was payable in respect of a house ... to a housing association within the meaning of sub-section (2) of section twelve of the Housing and Local Government (Miscellaneous Provisions) Act (Northern Ireland), 1946; and (b)that annual sum has been commuted; and (c)the house in respect of which the annual sum was payable before commutation has been destroyed or otherwise ceases to be used as housing accommodation; (i)that annual sum had not been commuted; and (ii)the house had not ceased to be used as housing accommodation. (2) Where any annual sum is payable to the Ministry in accordance with sub-section (1), ..., the housing association, may by agreement with the Ministry pay to the Ministry an amount in commutation of that annual sum, or a part thereof, and thereupon such annual sum or part thereof shall be deemed to be commuted accordingly.
