HISTORIC MONUMENTS ACT (NORTHERN IRELAND) 1971 - SECT 23

Prosecution of certain offences.

23.(1) In all cases of prosecutions for offences under this Act (other than
offences under [section 7(6), 10(1) or 21]), the complaint may notwithstanding
anything contained in section 34 of the Magistrates' Courts Act (Northern
Ireland) 1964, be made within three years after the commission of the offence
or within six months after the date when evidence sufficient, in the opinion
of the Ministry to justify a prosecution for the offence, came to the
knowledge of the Ministry, whichever period first expires.

(2) For the purposes of subsection (1), a certificate purporting to be signed
by an Assistant Secretary of the Ministry as to the date on which such
evidence as is referred to in that subsection came to the knowledge of
the Ministry shall be evidence of that date.
