Appropriation of payments. 53.(1) Where goods have been let under a hire-purchase agreement, or have been agreed to be sold under a conditional sale agreement, and a notice of default is served under section 25, then at any time after the service of that notice and before the amount specified in the notice is paid or tendered as mentioned in subsection (4) of that section or the period specified in the notice expires (whichever first occurs) the goods to which the agreement relates shall not be treated Para.(a) rep. by 1969 c.30 (NI) s.132 sch.6 (b)for the purposes of ... section 313 of the Irish Bankrupt and Insolvent Act 1857 (in this section referred to as "the Act of 1857"), as goods which are by the consent and permission of the owner or seller in the possession, order or disposition of the hirer or buyer. (2) Where under the powers conferred by Part III the court has postponed the operation of an order for the specific delivery of goods to any person, those goods shall not, during the postponement, be treated, for the purposes of ... section 313 of the Act of 1857, as goods which are by the consent or permission of that person in the possession, order or disposition of the hirer or buyer.
