Circumstances in which postponed order may be made. 37.(1) The court shall not exercise any power under this Part to make an order for the transfer to the hirer of the owner's title to part of the goods to which the agreement relates unless the court is satisfied that the amount which the hirer has paid in respect of the hire-purchase price exceeds the price of that part of the goods by at least one-third of the unpaid balance of the hire-purchase price. (2) In this section "price", in relation to any part of the goods to which the agreement relates, means such part of the hire-purchase price as is assigned to that part of the goods by the agreement, or, if no such assignment is so made, it means such part of the hire-purchase price as the court may determine.
