16.(1) Where a person (in this section referred to as "the owner or seller") lets goods under a hire-purchase agreement, or sells or agrees to sell goods under a credit-sale agreement or a conditional sale agreement, any representations with respect to the goods to which the agreement relates which were made, either orally or in writing, to the hirer or buyer by a person other than the owner or seller in the course of any antecedent negotiations conducted by that other person shall be deemed to have been made by him as agent of the owner or seller. (2) Nothing in this section shall exonerate any person from any liability (whether criminal or civil) to which he would be subject apart from this section. (3) Section 2(4) applies to this section. (4) In this section "representations" includes any statement or undertaking, whether constituting a condition or a warranty or not, and references to making representations shall be construed accordingly.
