Power to seek alternative grants. 3.(1) Where plans and specifications of a new house have (whether before or after the passing of this Act) been approved by a [district council] for the purposes of the payment of grants under Part III of the Housing (No. 2) Act (Northern Ireland), 1946, and the person providing the house satisfies the [district council] that (a)no grant has been paid under the said Part III in respect of that house; (b)if such plans and specifications had been submitted to the [district council] under section one of the Housing and Local Government (Miscellaneous Provisions) Act (Northern Ireland), 1946, they would have been approved by the [district council] under that section; and (c)he has made such a letting thereof as complies with the statutory conditions set out in section two of that Act; (2) The submission of plans and specifications under the said section one shall not preclude the person providing the house from electing [within such time after the house has been completed as the [district council] consider reasonable in the circumstances and before he has made such a letting thereof as is mentioned in paragraph (c) of sub-section (1) of this section] to withdraw the plans and specifications and submit them for approval under the said Part III. Subs.(3) repeals s.20 (pt.) of 1946 c.4 (NI). Citation and construction.
