39.(1) A [district council] may, at the request of a person who has in his possession any food which has not been sold, and which is not intended for sale, arrange to have that food examined on payment by that person of such fee, if any, as may be fixed by that [council]. (2) Subject to the provisions of section twenty-eight, where any food examined in pursuance of sub-section (1) is found to be unfit for human consumption, the [district council] may, with the consent of the person referred to in that sub-section, arrange for the disposal of the food.
