Withdrawal and substitution of respondents before trial. 90.(1) If before the trial of an election petition a respondent other than a returning officer gives the prescribed notice that he does not intend to oppose the petition, or dies, or (a)where the petition questions a parliamentary election or return, the House of Commons have resolved that his seat is vacant; or (b)where the petition questions a local election, he resigns or otherwise ceases to hold the office to which the petition relates; (2) A respondent who has given the prescribed notice that he does not intend to oppose the petition shall not be allowed to appear or act as a party against the petition in any proceedings thereon, and if the petition relates to a parliamentary election he shall not sit or vote in the House of Commons until the House of Commons has been informed of the report on the petition. Where a respondent to a parliamentary election petition has given the said notice in the prescribed time and manner, the High Court shall report that fact to the Speaker.
