1949 c.2 48.(1) Any person who knowingly or recklessly makes any false statement for the purpose of obtaining for himself or any other person any sum payable under section two shall, unless in the case of an indictable offence he is indicted for the offence, be liable on summary conviction to a fine not exceeding one hundred pounds or to imprisonment for a term not exceeding three months, or to both such fine and such imprisonment. (2) Any person who obstructs or impedes any person duly authorised under sub-section (4) of section two to make any inspection shall be liable on summary conviction in the case of a first offence to a fine not exceeding twenty pounds and, in the case of a second or subsequent offence punishable under this sub-section, to a fine not exceeding fifty pounds or to imprisonment for a term not exceeding one month, or to both such fine and such imprisonment. In considering for the purposes of this sub-section or sub-section (3) of section forty of the Agriculture Act (Northern Ireland), 1949, whether an offence is or is not a first offence, references to an offence punishable under this sub-section or that sub-section shall be taken as including references to offences punishable under that sub-section or this sub-section, as the case may be, or under sub-section (2) of section thirty of the Agriculture Act, 1937.
