35.(1) The Ministry may by order empower a [district council] to provide, erect, and fit up wharves, stations, lairs, sheds, and other places for the landing, reception, keeping, sale, slaughter or disposal of imported or other animals, carcases, fodder, litter, dung and other things. (2) An order made under sub-section (1) may, without prejudice to the generality of that sub-section, provide for all or any of the following matters, that is to say: [(a)the making by the [district council] of bye-laws for the regulation and control of any wharf or other place provided under the order and prescribing charges or tolls approved by the Ministry after consultation with the Ministry of Finance for the use of any such wharf or place or in default of such bye-laws the prescribing of such charges or tolls by an order of the Ministry made after consultation with the Ministry of Finance; (b)the application without modification or with such modifications as may be specified in the order of (i)all or any of the provisions of the Markets and Fairs Clauses Act, 1847 to or in relation to any such wharf or place;] Sub-para.(ii) rep. by SRO (NI) 1973/343 (c)the application by the [district council] of any moneys so received by them; (d)the making by the [district council] of such periodical returns of their receipts and expenditure in respect of any such wharf or place as may be prescribed by the order. (3) Where a [district council] is unable or unwilling to perform such functions as are referred to in sub-section (1), or where the council of a county or county borough satisfy the Ministry that it is impracticable or inexpedient that such functions should in their area be performed by the [district council], the Ministry may by order empower some other authority or person to perform those functions, and sub-section (2) shall have effect accordingly. An order made under this sub-section may make such modifications in section thirty-seven or section thirty-eight as appear to the Ministry to be necessary to give effect to the order. (4) An order under sub-section (3) shall be subject to negative resolution.
