Power, on indictment for rape, to convict of certain offences. 9.(1) A person indicted for rape may, if the evidence does not warrant a conviction of rape but warrants a conviction of an offence under section 3 of this Act or of indecent assault, be found not guilty of rape but guilty of an offence under the said section 3 or of indecent assault. (2) A person indicted for an offence under section 4 of this Act may, if the evidence does not warrant a conviction of an offence under the said section 4 but warrants a conviction of indecent assault, be found not guilty of an offence under the said section 4 but guilty of indecent assault.]
