163.(1) Where, in consequence of any investigations arising out of the alleged commission of an offence, a member of the Royal Ulster Constabulary is of the opinion that a child or young person may be in need of advice, guidance or assistance for any reason and is not to be brought before a court, it shall be his duty to notify [the Ministry of Home Affairs] .... (2) Where [the Ministry of Home Affairs] are notified under subsection (1) that a child or young person may be in need of advice, guidance or assistance, it shall be their duty to cause inquiries to be made into the case, unless they are satisfied that such inquiries are unnecessary.
