Alternative provisions as to annual and final meetings in case of insolvency. 261.(1) Subject to sub-section (2), where section two hundred and fifty-eight has effect, sections two hundred and sixty-nine and two hundred and seventy shall apply to the winding up to the exclusion of sections two hundred and fifty-nine and two hundred and sixty, as if the winding up were a creditors' voluntary winding up and not a members' voluntary winding up. (2) The liquidator shall not be required to summon a meeting of creditors under section two hundred and sixty-nine at the end of the first year from the commencement of the winding up, unless the meeting held under section two hundred and fifty-eight is held more than three months before the end of that year. Provisions applicable to a creditors' winding up.
