Supplementary provisions as to directions under s.51. 53.(1) The registrar may, subject to subsection (2), at any time serve a notice on a building society, or on any person who has in his possession or under his control any books, accounts, deeds or other documents relating to the business of a building society, requiring the society or other person to produce to the registrar such of those documents as the registrar considers necessary for the exercise of his powers under sections 48 to 52. (2) The registrar shall not have power under subsection (1) to require the production of documents which do not belong to the building society, and which are not deeds relating to property mortgaged to the society, (a)from a person who is or has been an auditor of the society; or (b)from anyone other than a person who is or has been an officer or servant of the society. (3) The registrar may also at any time serve a notice on a building society, or on any person who is or has been an officer or servant of a building society, requiring the society or other person to furnish him with such information relating to the business of the society as the registrar considers necessary for the exercise of his powers under sections 48 to 52. (4) Any notice under subsection (3) may contain a requirement that any information to be given in accordance with the notice shall be verified by statutory declaration. (5) If a building society fails to comply with the requirements of a notice under this section, the society shall be liable on summary conviction to a fine not exceeding two hundred pounds, and every officer of the society who is in default shall be liable on summary conviction to a fine not exceeding two hundred pounds, or to imprisonment for a term not exceeding three months, or to both. (6) If any person other than a building society fails to comply with the requirements of a notice under this section, he shall be liable on summary conviction to a fine not exceeding two hundred pounds, or to imprisonment for a term not exceeding three months, or to both.
