Interpretation of Part II. 23. In this Part the expression "approved horse racecourse" means a horse racecourse occupied by a body corporate which satisfies the Ministry of Home Affairs that it (a)is not conducted for purposes of private gain; (b)will receive the whole of the amount by which the gross profits to be derived from the operation of any licensed totalisator set up on the racecourse will exceed the amount of the expenses reasonably and properly incurred in earning those profits; (c)is required by the terms of its incorporation to devote a substantial proportion of its profits to improving the breed of horses in Northern Ireland; and (d)devotes a substantial proportion of its profits to that purpose.
