THE INDUSTRIAL TRIBUNALS
CASE REF: 11014/19
CLAIMANT: Patrick Totten
RESPONDENTS: 1. Sizzlers (NI) Ltd
2. Kate Clarke
3. Paul Clarke
4. Department for the Economy
JUDGMENT
The claimant’s unfair dismissal claim is well-founded.
It is ordered that in respect of unfair dismissal, the claimant is awarded the sum of £2,025.60 (which is the basic award element of the claimant’s unfair dismissal compensation). The basic award is an award of four weeks’ pay based on the claimant’s gross weekly pay of £506.40.
The basic award amounts to four weeks’ pay because of the effect of Article 130A(1)(a) of the Employment Rights (NI) Order 1996 (as amended).
The amount of any compensatory award can be assessed during the course of any remedies hearing if the claimant asks for such a hearing to take place.
This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
