The claimant appeared in person.
The first respondent was neither in attendance nor represented. The second respondent was represented by Ms A Moody from the Redundancy Payments Service.
1. The claimant brought a claim for unpaid wages and unpaid holiday pay.
2. The first respondent did not enter a response and has now gone into liquidation.
3. At a Case Management Discussion on 2 October 2018 Employment Judge Buggy joined the Department for the Economy as a second respondent following the claimant’s unsuccessful application to the Redundancy Payments Service for payment of his unpaid wages and holiday pay. His application had been refused by reason of lack of information from the claimant and the claimant’s former employer, the first respondent.
4. At the Case Management Discussion on 28 August 2018 Employment Judge Buggy listed today’s hearing as an appeal against the refusal by the second respondent to award to the claimant a sum of money for his unpaid wages and holiday pay.
5. The appeal came on for hearing on today, 25 March 2019.
6. The tribunal heard evidence from the claimant and submissions on behalf of the claimant and the second respondent.
7. I am satisfied that the Department ought to make a payment to the claimant in relation to his unpaid wages, which I calculate at £1,163.25, and for non-taken holiday leave to which he was entitled which calculation was agreed by the parties, and I accept, at £135.36.
8. An oral decision was given on 25 March 2019 during which I gave the reasons for my decision.
9. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
