1. The time for presenting a response having expired, the tribunal declares that the following complaints are well-founded:-
(i) failure to make a redundancy payment;
(ii) breach of contract (notice pay).
2. I therefore order as follows:-
(i) The claimant is entitled to a redundancy payment calculated as follows:-
On the termination of her employment she had three full years of completed service and was aged 55. Her gross pay was £187.92 per week.
The appropriate multiplier for calculating her redundancy payment is 4.5.
Her entitlement is therefore:-
£187.92 x 4.5 = £845.64.
(ii) The claimant by virtue of her service is entitled to three weeks’ notice pay at £186.40 net per week. The claimant received one week’s notice pay. I therefore order that the respondent do pay the sum of £372.80 in respect of outstanding notice pay.
3. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
