CASE REF: 7501/19
CLAIMANT: Leona McNulty
RESPONDENTS: 1. APG Supplies & Services
2. Peter Gallagher
DEFAULT JUDGEMENT
Employment Judge: Employment Judge Ó Murray
1. The time for presenting a response having expired, the tribunal declares that the following complaints are well-founded:-
(i) failure to make a redundancy payment;
(ii) breach of contract (notice pay).
2. I therefore order as follows:-
(i) The claimant is entitled to a redundancy payment calculated as follows:-
On the termination of her employment she had completed three full years of service and was aged 21. Her pay was £183.40 per week.
The appropriate multiplier for calculating her redundancy payment is 1.5.
Her entitlement is therefore:-
£183.40 x 1.5 = £275.10.
(ii) The claimant by virtue of her service is entitled to three weeks’ notice pay at £183.40 per week. I order that the respondent do pay the sum of £550.19 in respect of notice pay.
(iii) I order that the respondent do pay to the claimant the sum of £88.92 in respect of unpaid holiday pay.
3. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
